First Lt. Ehren Watada will not face a second court martial for refusing to deploy to Iraq.

The Hawaii-born soldier was court-martialed in 2007 but the case ended in a mistrial.

The Dept. of Justice dropped its appeal of a judge’s decision that said retrying Watada on key charges would be double jeopardy.

He could still face punishment for charges of conduct unbecoming an officer.
