Court Martial Attorney – Special Court Martial proceedings begin for Marine in connection with Juliett fires

CAMP PENDLETON – Special Court Martial proceedings for LCpl. Nason G. Lamb will begin tomorrow at 8 a.m. here. Lamb has been charged with one specification of Article 107 – False official statement, one specification of Article 108 – Damage to Military Property and three specifications of Article 134 – Reckless Endangerment; Setting Fire To U.S. Property; and Setting Fire That Damaged California Property, all in connection with the Juliett 2 Fire.

It is important to note that the charges and specifications are accusations against the individual and that the accused is presumed innocent until proven guilty.

Based on the findings of a comprehensive fire investigation by base fire officials and with the assistance of an investigator from the California Department of Forestry and Fire Protection, it has been determined that two separate fires, designated the Juliett 1 and Juliett 2 Fires, started here the afternoon of October 13, 2008. The Juliett Fires were declared 100 percent contained at approximately 6 p.m. October 17, 2008. The fires burned approximately 4000 acres.

Based on the findings of a Naval Criminal Investigative Service investigation, the Juliett 2 Fire was allegedly started by a Marine during a land-navigation exercise in the Juliett Training Area.

Further findings of the fire investigation indicate the exact cause of the Juliet 1 Fire has not been determined, however, natural causes and the use of military training ordnance and/or fire-producing training aids have been ruled out. A criminal investigation remains open on the Juliett 1 Fire.

Details of these investigations could be presented as evidence for any potential legal proceedings and will not be released to the public at this time.
