Court Martial Attorney – Pair cleared of stripping soldier

Two Essex-based paratroopers accused of humiliating a 19-year-old soldier in Afghanistan have been cleared at a military trial in Colchester.

L/Cpl Jamie Morton and Pte Christopher Martin were found not guilty of disgraceful conduct of an indecent kind, a court martial spokesman said.

Prosecutors say the soldier was stripped naked, handcuffed and held down before being indecently assaulted.

L/Cpl Peter McKinley, who remains on trial, denies any wrongdoing.

‘Red eye’

The spokesman said Judge Advocate Michael Hunter had recorded not guilty verdicts on L/Cpl Morton and Pte Martin after prosecutors said they would not be offering any further evidence against the men.

The pair had both denied any wrongdoing.

On 29 April two other soldiers, Cpl Simon Scott and L/Cpl Ian Greenslade, were also cleared of being involved.

Prosecutors allege that the teenage soldier was subjected to the humiliating ritual, known in the Army as “red eye”, while serving in southern Afghanistan in the autumn of 2006.

The assault on the soldier, who cannot be identified for legal reasons, was videoed and photographed, prosecutors said.

The trial continues.
